20 yos are plenty capable of making intelligent decisions if they don't use youth as an excuse.
It's illegal for him to drink in this state at 20. It's illegal to drive when under the influence in this state. Obviously that doesn't bother him anymore than the existing novice/AWD rule. I hope he didn't bang a 12yo the same night... I do agree with the attorney part as the penalties can get way out of hand and aren't always the same across the board. We need to lighten up a bit on first timer DUI and slap the piss out of un-insured drivers. YOU do have insurance??? |

I'll explain what I meant. I had a GF that worked at a counseling agency,drugs and alcohol. If someone got a DUI and had to go to counseling as part of the sentence, this was the place. It cost the guilty party a fair amount of jingle. Now it gets tricky. The counseling agency decides how long you go and when treatment is done. Pretty self serving. I remember one of the counselers showing up at a Xmas party with a black eye from her hubby smacking her. Another drove a total POS because she couldn't manage to pay her bills. A couple were rehabbed themselves and at least one had a pretty good pot problem. Damaged goods at best. This is the part of DUI I don't agree with, especially first time offenders. Fine them, jail time is ok, maybe order a certain time to undergo treatment but limit that. 2nd offenders, throw the book at them. No mercy. It is a huge these days and needs dealt with, but fairly. Its a crime, same as rape, armed robbery or building Volvo race cars . But seriously, 20 is more than old enough to know right from wrong and avoid situations that lead to disaster. They just had a news story on KING about our little town football team having nine members busted for drugs. Last years senior class was just as bad. Several were having UAs done and they devised a scheme where one clean kid would piss in a condom and they carried that on board. 2 of my sons classmates were killed coming back from a party in the woods their senior year in 07. It just isn't ok at 20, or 16 or 60. |

So out of curiosity I did a quick Google search. Apparently getting a DUI when you are under 21 is not that big of a deal! This really pisses me off!
Driver Under 21 Consuming Alcohol (“Minor DUIâ€) The crime of "driver under twenty-one consuming alcohol," sometimes called a "minor DUI," is classified as a misdemeanor and punishable by 0-90 days in jail and a $0-$1000 fine. If you are under age 21 and are either driving or in physical control of a motor vehicle with a breath or blood alcohol content of 0.02 – 0.079 within 2 hours of the time of the incident, you can be arrested for this charge. A “minor DUI†conviction carries no mandatory jail, fines, or ignition interlock device requirement. If you are convicted of a “minor DUI†and face the unfortunate situation of later being accused of a DUI / DWI charge, then the prior “minor DUI†is not considered a “prior†for purposes of mandatory penalty enhancements in the new case. However, a judge would likely take it into consideration at sentencing. An arrest for a "minor DUI" triggers a mandatory license suspension of at least 90 days by the Department of Licensing. This is based on Washington’s Implied Consent Law. You can (and we recommend should) contest this suspension by filing a request for a hearing with the Department of Licensing. This must be filed with the Department of Licensing within 20 days of the arrest for you to obtain a hearing. More information on DOL hearings can be found at: DOL Hearings. If you are not a U.S. citizen, a minor DUI does not typically have any adverse affects on your status in the United States. My senior year one of my teachers told us at the beginning of the school year that we would loose someone we knew to an alcohol related accident, and it happened. 4 kids coming back from a party, the driver was being stupid and rolled the car, killing 2 passengers. |

Robert, the levels mentioned are pretty low .02-.079. anything over .08 and the crime is full on. Interesting article though. Kind of a one chance while you're in hi school thing. Well intentioned but not what we need. The zero tolerance thing is more better. Drink at home I can deal with, stay off the roads. Kids that age don't have the driving skills to be driving even a little bit imparied.
Back in the day..we didn't have any serious alcohol or drug education in school. Our local cops were real dicks though. One kid actually got a speeding ticket on a skate board. I got taken to the county jail late one night because the city cop said he heard a car squealing tires. He saw me on the road coming home from work and wrote me up....I had a flat head 6 Studebaker..it wasn't me. That one never even went to court. I think we lost one kid to booze back then. It didn't seem to be the problem as now even with 'Nam and the revolution. I think less kids drove in the small town /farm environment. |

My small town, around 50k, drinking was all anyone did. Applies to most of Wyoming. There's nothing really to do, there's no public transportation, there's maybe two cabs, and mostly fairly low income. I can think of four people who I went to school with that have died in drinking related accidents.
Colorado and New York have this stupid MADD influenced limitation called Driving While Ability Impaired. 0.05-0.79. They also got DUI lowered to 0.08. They also then had to change laws to allow patrons to leave a restaurant with a corked bottle of wine since now all couples would likely be over the limit after leaving a nice dinner. Now they're trying to figure out a test to start issuing citations to stoned drivers. They're easy to spot cause they usually are going 10 under the speed limit. |

I got a dui once.
I've wrecked a few cars. (some weren't even mine) Stole a bulldozer for a few hours. (THAT was fun) got in a huge fight w/my parents and wasn't on speaking terms w/them for a few months. I even got turned into a newt by a witch! (I got bettah) However, i've done these things over a span of the last 20 years; not all in the same month. (although, its been a while since I stole that bulldozer) Take it easy....calm down, breath. but you might want to sell that car and not worry about rally for a bit....maybe, like....10 years? |

50K is small?? LOL....my hometown in VT had 5,000 people in it. You had to drive 30 minutes just to get to a stop light. VT was actually pretty strict with drinking and it was damned near impossible to get a fake ID, so when we did get alcohol, we'd go sneak off in the woods somewhere and camp out, get drunk, and fuck squirrel holes. |

10 years? really, that seems a little harsh no? i was thinking id sell the car, get through all this DUI stuff, and move to burien. then go to highline community college, transfer to a university, and in 5-6 years ill be rallying... maybe 7 since the DUI will probably set me back a year or so. i was going to join the navy or airforce, but i think that is out of the question now that i have a DUI. Either way i made a really stupid decision, but ive gotta say, its almost inevitable that i get into trouble someway or another living on this island. I've lost 3 friends on this island due to drunk driving, but even more to the island itself. ive seen lots of kids my age get out of highschool and just hang around here, until they get into drugs and shit, and then its a long slippery slope down from there on out.
